Licence Limitations

These differ slightly between licences, but here are the main limitations. Anyone wishing to copy beyond these limits, or from works outside the licence should contact the rightsholder for permission, in order to avoid infringing copyright.

a) No copying may exceed 5% of the published volume or issue or, if greater:
• One complete chapter from a book
• Or one article from a journal or periodical
• One entire case from a law report
• One paper of one set of conference proceedings
• A short story or poem not exceeding 10 pages in length

b) The licensee must own an original and/or copyright fee paid copy of any licensed material it copies under the Licence

c) The number of copies taken must not exceed the number required to ensure there is one copy for the teacher and each pupil or student in the class for that lesson or enrolled on the course. Copies may also be taken for meetings with parents, teachers and governors, but copying amounts are limited to the numbers attending the meeting.

d) No copies shall be sold, hired out or otherwise disposed of for valuable consideration

e) Copies made under the licence must not be used to substitute for the purchase of original material

f) Copies made by schools may be used for one academic year and must then be destroyed

g) No systematic or repeated copying of the same licensed material is permitted

h) Digital (scanned) copies may not be stored or systematically indexed with the intention of creating an electronic library or similar information resource

i) Copies cannot be taken of works published outside the UK, Argentina, Australia, Canada (inc Quebec), Denmark, Finland, France, Germany, Greece, Iceland, Ireland, Luxembourg, The Netherlands, New Zealand, Norway, South Africa, Spain, Sweden, Switzerland (inc Liechtenstein) and USA (only certain publishers in the USA participate in the scheme as per the list on the CLA website )

j) Titles included on the List of Excluded Categories and Works List cannot be copied.

k) Copying for visually-impaired pupils or staff-accessible copies (eg enlarged or reduced copies) may be made for use by visually-impaired pupils or staff. The 5% limitation does not apply to copying under this provision. Accessible copies may only be produced under the licence if there is no suitable accessible version commercially available. No charge is made for this provision.

Copies may be made or received by

• registered students, contracted members of staff and visiting academics based in the United Kingdom can make and receive photocopies of extracts of licensed material
• registered students and contracted members of staff based outside the United Kingdom can receive photocopies of extracts of licensed material
• officers contracted by regulatory agencies such as the Quality Assurance Agency and the Research Assessment Exercise can receive photocopies of extracts of licensed material

Digital

All licences allow for the digital copying (scanning) of print original material. This includes faxing, or retyping from published sources using a computer. The Model Law licence, and the Schools licences are the two most recent licences to be given digitisation rights.

Scanning under the HE trial scanning licence can only be carried out by specifcially designated staff who can copy into a secure intranet restricted to the students on particular courses. Only UK publications may be scanned.

No copying from digital originals is permitted under the licences, except under the new ABPI (Pharmaceutical), Business, and Public Administration Collective Digital Licences.

The CLA licence does not apply to any material on the internet.

The only CLA licences to apply to CD-ROM or DVD based materials are the Collective Digital Licences. Otherwise, these are sold with a licence from the publisher that should explain what printing and on-copying of the material on the disc (if any) is allowed.

Anyone wishing to copy beyond these limits or from works outside the Licence should contact the copyright holder(s) for permission and copying without permission could put the organisation at risk from legal action for infringement of copyright.
